Summary
Most people accept Supreme Court decisions, even when the Justices themselves vigorously criticize each other’s opinions. But recent cases, with the frequency of their 5-4 decisions, cause concern as to the direction in which the Rule of Law is being taken. Both conservatives and liberals are concerned as to who will be appointed to fill vacancies when one or more current Justices retire or die. Building precedent upon precedent, using so-called stare decisis, has led to consequences not intended by the courts which created the earlier precedents. For example, the cultural decline in morals is an unintended consequence of decisions made by the United States Supreme Court in the name of individual “rights”. Some of these decisions even redefined the terms of the Constitution or added “rights” not mentioned in the text of either the Constitution or the Bill of Rights, such as the so-called “right to privacy” invented by Justice Douglas. The thesis of this book is that lawyers and judges, - especially Christian lawyers and judges - know the difference between right and wrong; so that, by their collective and continued leadership and influence, American culture may be restored to that which was exemplified by “the Greatest Generation”. Indeed, all who recognize and respect moral values are invited to join. So the Rule of Law and the Spirit of the Law become premises for the conclusions we shall draw.
About the Author
Robert J. Turley is a trial lawyer, now semi-retired. He was listed among The Best Lawyers in America, as well as in Who’s Who in American Law. He is a member of the Ethics Committee of the Kentucky Bar Association. The Kentucky Bar Association gave him its 2001 Outstanding Lawyer Award. His other awards include the Trinity Baptist Church Civic Appreciation Award and the Henry T. Duncan Memorial Award given to him by the Fayette County Bar Association. He is a member of Broadway Christian Church, where he teaches Sunday School. His grandchildren were the inspiration for Turley’s first book, The Choices Are Yours. His second book, The Bridge of Faith, was released in September, 2000.
